Services
We provide website development, custom software application engineering, and IT services as agreed upon in project proposals, or contracts.
The proposals may come in the form of email, written documents, or digital agreements.
Payment Terms
All invoices are due within fifteen (15) days of the invoice date (Net 15). Late payments may incur additional fees or service suspension.
Intellectual Property
Unless otherwise agreed in writing, all intellectual property rights in deliverables remain with JKagiDesigns LLC until full payment is received.
Unless otherwise agreed in writing, JKagiDesigns LLC reserves the right to use any deliverables for promotional purposes or future projects with other clients.
Limitation of Liability
JKagiDesigns LLC is not liable for any indirect, incidental, or consequential damages arising from the use of our services.
While performing service work, installations, repairs, or other on-site services, JKagiDesigns LLC takes all reasonable precautions to protect customer data and personal property. However, you acknowledge and agree that JKagiDesigns LLC is not responsible for any loss of data, or any damage to personal property that may occur in connection with the performance of such services, except to the extent caused by our willful misconduct or gross negligence. To the maximum extent permitted by applicable law, you agree that the sole and exclusive remedy for any claim arising out of or related to our services shall be a refund of amounts actually paid for the specific services giving rise to the claim, and you hereby waive any right to recover additional damages or to initiate legal action (including class actions) against JKagiDesigns LLC for such claims. Nothing in this section is intended to limit any liability that cannot be excluded or limited under applicable law.
Changes to Terms
We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of the revised Terms.
